This Trust Center provides information regarding the security, privacy, and compliance practices of Function AI LLC (“Function AI,” “Company,” “we,” “us”, or “our”) in connection with our website, platform, and services (collectively, the “Services”).

This Trust Center is intended for informational purposes only and does not amend or supersede any agreement between Function AI and its customers, including any Terms of Service, Data Processing Addendum, or other binding agreement.

1. COMMITMENT TO SECURITY AND PRIVACY. Function AI is committed to protecting the confidentiality, integrity, and availability of the information entrusted to us. We maintain administrative, technical, and physical safeguards designed to protect personal data and other sensitive information against unauthorized access, disclosure, alteration, or destruction.

2. SECURITY PROGRAM. Function AI maintains a risk-based information security program designed to align with generally accepted industry standards.

2.1 Administrative Safeguards. We implement administrative measures including (i) written information security policies and procedures, (ii) personnel confidentiality obligations, (iii) security awareness and training programs, and (iv) vendor risk management practices.

2.2 Technical Safeguards. We implement technical safeguards including, (i) encryption of data in transit using industry-standard protocols (e.g., TLS), (ii) encryption of data at rest where appropriate, (iii) access controls based on least-privilege principles, (iv) authentication mechanisms, including multi-factor authentication where appropriate; and (v) system monitoring, logging, and anomaly detection.

2.3 Physical Safeguards. We utilize commercially reasonable physical safeguards, including secure hosting environments and data center access controls (where applicable through third-party providers).

3. ACCESS CONTROLS AND DATA HANDLING. Function AI limits access to personal data to authorized personnel who require such access to perform their job functions. Access is provisioned based on role and responsibility. Access rights are reviewed periodically. Access is revoked promptly upon termination or role change. We apply data minimization principles and limit data collection and retention to what is reasonably necessary to provide the Services.

4. DATA PROTECTION AND PRIVACY.

4.1 Function AI processes personal data in accordance with applicable data protection laws and contractual obligations/. We limit use of personal data to specified and lawful purposes and do not sell personal data for monetary consideration. We require third parties to adhere to appropriate data protection obligations.

4.2 Where applicable, we support customer compliance with General Data Protection Regulation, California Consumer Privacy Act and other applicable U.S. and international privacy laws.

5. SUBPROCESSORS AND THIRD PARTIES.

5.1 Function AI engages third-party service providers (“Subprocessors”) to support the operation of the Services, including cloud hosting, analytics, and infrastructure services.

5.2 We conduct reasonable diligence prior to engaging Subprocessors, require contractual commitments regarding data protection and confidentiality, and monitor Subprocessor performance where appropriate. A list of Subprocessors is available upon request.

6. INCIDENT RESPONSE. Function AI maintains an incident response program designed to detect, respond to, and mitigate security incidents. In the event of a confirmed security incident affecting personal data, we will take reasonable steps to contain and remediate the issue, notify affected customers in accordance with applicable law and contractual obligations, and provide information reasonably necessary for customers to meet their legal obligations. Notification does not constitute an admission of fault or liability.

7. DATA RETENTION AND DELETION. Function AI retains data only as long as necessary to provide the Services, comply with legal and regulatory obligations, and resolve disputes and enforce agreements. Upon termination of Services, data is handled in accordance with applicable agreements and legal requirements.

8. COMPLIANCE AND CERTIFICATIONS. Function AI’s security and privacy practices are designed to align with recognized industry frameworks. Where applicable, we may undergo independent assessments, maintain certifications or reports (e.g., SOC 2), and provide documentation under confidentiality. Availability of specific certifications may vary and may be subject to non-disclosure obligations.

9. BUSINESS CONTINUITY AND AVAILABILITY. Function AI maintains measures designed to support system availability and resilience, including (i) redundancy and failover mechanisms where appropriate; (ii) backup and recovery processes; and (iii) monitoring of system performance. We do not guarantee uninterrupted or error-free operation of the Services.

10. RESPONSIBLE USE OF TECHNOLOGY. Function AI designs its systems, including any automated tools, to support human decision-making and not to replace it. We implement reasonable measures intended to promote fairness and consistency, reduce risk of unintended bias, and improve transparency where appropriate.

11. CUSTOMER RESPONSIBILITIES. Customers are responsible for complying with applicable laws, including employment and privacy laws; obtaining required consents and authorization; and implementing appropriate security controls within their own systems. Function AI does not control how customers use information obtained through the Services.

12. LIMITATIONS. This Trust Center is provided for general informational purposes, does not constitute a warranty or guarantee, and does not create legally binding obligations beyond those set forth in applicable agreements.

13. UPDATES TO THIS TRUST CENTER. Function AI may update this Trust Center from time to time to reflect changes in our practices or legal requirements. The “Last Updated” date will reflect the date of the most recent revision.
